Tenant seeks justice after woman destroyed former property in protracted divorce case

A tenant in a Karen residence in Nairobi  is seeking justice after a rogue woman invaded his house, accompanied by hounds of goons, stealing property and causing destruction.

The woman, one Mary Waithera Gikonyo, obtained a court order allowing her access to the house originally rented and occupied by her divorced husband, the house was leased out to the current occupant Mr. Eric who has been residing at the residence until Waithera, falsely believing that the house was her property of her ex-husband,descended on his house.

Mary Waithera and her former husband lived in the Karen house as tenants and were evicted over rent distress amounting to over Ksh 4 million. The true documented position is however indicate that the house belongs to another party. 

The couple were distressed for failure to pay rent through a court order and the landlord engaged Mr Eric as a tenant since August 2024.

The matter is pending before justice Riechi at Milimani  family division court for determination. 

It is thereafter that Waithera obtained orders from  the courts to the landlord granting  stay orders to allow her unlimited access to the house. Courts didn’t consider the fact that there was a legitimate tenant. 

Waithera is accused of organising  goons who broke the premises and stole cash and valuables from the tenant. Tenant confronted her and there  was serious altercation.

 Waithera unlawfully invaded the house in the company of paid goons vandalizing the house.

According to Eric, the woman and her goons stole one million shillings from the house as well as other electronic accessories like mobile phones including iphones, laptops among other valuables. Eric has demanded compensation noting that the court orders obtained by Waithera allowed her access to the house not an order to evict the tenant or vandalize property.

In the court orders issued by Milimani Chief Magistrate Lucy Ambasi, the court  issued an order directing the respondents to reopen the account for and provide an itemized list of all the goods proclaimed and carted away.

pending the hearing and determination of the application where Waithera went to court to seek orders against her divorced husband restraining him from selling of moving matrimonial property from the house.

However, the husband had already went on to lease the house to Eric and him being a lawful occupant is demanding compensation for the damage adversely caused by Waithera and her goons noting that he is not party to the matrimonial dispute and his tenancy should not be affected by the ongoing legal battles.

Eric noted that the lady contravened the law by forcefully entering the property and leading in the demolition of the gate and other amenities as her goons stole valuables and has demanded that justice be served.
